In short: Fikra Smart is an educational tool for teachers. You are responsible for the content you create, upload, or share through it. The platform is provided "as is", AI-generated content must be reviewed before use, and we are not liable for user content or for how the platform is used.
1. Acceptance of These Terms
By creating an account, joining a session, or otherwise using Fikra Smart ("the Service"), you agree to these Terms of Use. If you do not agree, please do not use the Service. If you use the Service on behalf of a school or institution, you confirm you are authorized to accept these terms on its behalf.
2. What Fikra Smart Is
Fikra Smart is a digital classroom platform: an interactive whiteboard with lesson management, classroom games and activities, student participation tools, and AI-assisted content generation. The Service is intended solely for educational purposes. It is not designed or offered for any other use.
3. Accounts & Eligibility
- Teacher accounts may only be created by adults (18+) — teachers, educators, or school staff.
- You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.
- You may not share, sell, or transfer your account to others.
4. Students & Minors
Students join sessions with a display name and a class code provided by their teacher — no student email, password, or personal profile is required. Student participation happens under the supervision and responsibility of the teacher and the school.
- The teacher/school is responsible for obtaining any parental or institutional consent required by local law before having students use the Service.
- Teachers should instruct students to use first names or nicknames only, and must not enter sensitive personal data about students into the Service.
5. Your Content & Your Responsibility
You keep ownership of the lessons, files, images, questions, and other materials you create or upload ("User Content"). You grant us a limited license to store, process, and display that content only so the Service can work (e.g., syncing lessons to your devices and showing activities to your students).
You are solely responsible for your User Content. Fikra Smart and its owner do not review, endorse, or take responsibility for content created, uploaded, or shared by users. Any content that violates law, copyright, or school policy is the responsibility of the user who created or shared it.
You agree not to upload or share content that is illegal, infringing, hateful, violent, sexually explicit, misleading, or otherwise inappropriate for an educational environment.
6. AI-Generated Content
Some features (lesson generator, worksheet generator, sticker creator, AI assistant, and similar tools) produce content using third-party artificial intelligence models. AI output can be inaccurate, incomplete, or inappropriate despite our safeguards.
- You must review AI-generated content before using it in a classroom.
- AI output is provided for inspiration and drafting; it is not professional, pedagogical, medical, or legal advice.
- We are not liable for decisions made, or harm caused, by relying on AI-generated content without review.
7. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of school or institutional rules;
- attempt to breach, probe, or overload the Service, its servers, or its security measures;
- copy, scrape, resell, sublicense, reverse-engineer, or create derivative versions of the Service;
- impersonate another person or misrepresent your affiliation;
- use the Service to harass, bully, or harm any student or other person.
8. Intellectual Property
The Fikra Smart platform — its design, code, name, logo, and features — is the intellectual property of Mohammad Izzat Saeed Awwad and is a registered intellectual work with the UAE Ministry of Economy & Tourism (Intellectual Works Rights Registration, Certificate No. 1810-2026, dated 11-06-2026). All rights reserved. No part of the Service may be copied, redistributed, or commercially exploited without prior written permission.
9. Third-Party Services
The Service relies on third-party providers (including hosting, database/authentication, and AI model providers). Their availability and terms are outside our control. Links or embedded third-party content (e.g., fonts, libraries, search results) are governed by those parties' own terms and privacy policies.
10. Privacy & Data
- Teacher accounts store: name, email, and the content you create.
- Student sessions store: the display name entered and activity results (e.g., quiz scores) linked to the teacher's class.
- We do not sell personal data. Data is stored with reputable cloud providers and protected by access rules.
- You may request deletion of your account and associated data by contacting us.
11. Service Availability — "As Is"
The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy, or uninterrupted availability. Features may change, be suspended, or be discontinued at any time. You are responsible for keeping backup copies of content that matters to you (e.g., exporting lessons to PDF).
12. Limitation of Liability
To the maximum extent permitted by applicable law, Fikra Smart and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, classroom disruption, or damages arising from user content, AI-generated content, third-party services, or unauthorized access — arising out of or related to your use of (or inability to use) the Service.
13. Indemnification
You agree to indemnify and hold harmless Fikra Smart and its owner from any claims, damages, or expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these terms or of applicable law.
14. Suspension & Termination
We may suspend or terminate accounts that violate these terms, harm other users, or abuse the Service, with or without notice. You may stop using the Service and request account deletion at any time.
15. Changes to These Terms
We may update these terms from time to time. The "Last updated" date above reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
16. Governing Law
These terms are governed by the laws of the United Arab Emirates. Any dispute arising from these terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
